1. Contract of hire
All bookings accepted are subject to the following conditions, which are deemed
to be accepted in full by the hirer and all persons in the party. Availability
must be checked by telephone or email and you will be given a provisional
booking. The booking form can
be sent by post or email and would be deemed to be accepted once
payment and the booking form have both been received.
2. Booking deposit
A non-refundable booking deposit of 30% of the total rental is required to
secure your booking. You can pay by bank transfer or cheque, your provisional booking will be held for
3 days. If your booking is made within 8 weeks or less
from your departure date it must be accompanied by full payment. Your booking is
only confirmed upon receipt of your payment and this will be confirmed in
writing.
3. Payment of the balance
The balance must be paid 8 weeks prior to the hire commencement date. This payment
must include the extra £200 security deposit against any damage or breakages or
the property being left in a unacceptable state. This £200 will be
refunded within 2 weeks of completion of your holiday, less any cost of damages,
breakages or loss of goods, extra cleaning needed. If we do not receive the balance by the seventh week
prior to your commencement date we shall be entitled to cancel the booking
without prejudice.
5. Welcome Packs
Welcome packs are available on request including bread,
milk, tea, sugar, coffee, bottled water etc - £25.
6. Occupancy
Only persons accompanying the named guest on the booking may occupy the
property or use the pool. The property cannot be re-let or sub-let. Under no circumstances
may more than the maximum number occupy the property,. The owners reserve the
right to refuse admittance to the hirer and party if they are in breach of this
condition. We do not accept pets in the property.
7. Cancellation by the hirer
Cancellation of booking must be in writing or by email. If this is 8
weeks or more prior to the holiday commencement date, only the deposit will be
forfeited. If cancellation is between 4 and 8 weeks prior to
the holiday commencement date, 75% of the full cost is to be paid. Less than 4 weeks, there
will be no refund. It is a condition of booking that full insurance is
taken out to cover cancellation.
8. Alterations or
cancellation by us
In the unlikely event that the property becomes unavailable, the hirer will be offered a full refund. Any
refund is restricted to the property hire costs and the owners are not liable
for any cancellation or administrative charges for travel arrangements, etc.
9. Arrival and departure
times
Occupation is from 4 pm on the day of
arrival and the villa must be vacated by 10 am on the day of
departure. If arriving in Cyprus before 4pm, luggage can be
deposited in the covered car port at the owner's risk. A
later time for
your departure can sometimes be
arranged with the caretakers (no more than two days before you
leave) at a cost of half a day’s rental
(including air conditioning if required) but only if there are
no clients arriving the same day. Alternatively,
the caretakers may be able to keep luggage at their house until
departure at a cost of 15 euros for up to 8 hours i.e. until 6pm
at the latest. You
might wish to consider booking the extra day at the full rent to
ensure you have the convenience of the facilities until you
need to leave for your flight.
10. Keys and directions
Detailed instructions for key access and directions will be sent to you on
receipt of the balance.
11. Complaints
In the unlikely event that you have a complaint about the property or its
contents whilst on holiday, it must be reported immediately to Carol Symon. The owners will have no liability for any complaint
not reported immediately or submitted after completion of the hire period. The
caretakers
must be given access to the property if you have a problem and you must agree to
meet with them to discuss any situation which may arise. You must
also formally confirm your complaint in writing to Carol Symon within 21 days
of your return from holiday.
12. Hirer’s responsibility
The hirer is responsible for taking reasonable care of the property and its
contents. Bath/hand towels should only be used inside the villa and not taken
out to the pool area. At the end of the hire period, the property should be left in a
reasonable state and its contents,
including all equipment, furniture and utensils, etc must be left clean and
tidy which includes the crockery and cutlery cleaned and stored in the
appropriate cupboards, and ensure that the cooker, microwave, fridge and
barbeque are clean.
All breakages must be
reported no matter how small. The hirer shall ensure that no member of the party engages
in any activity in or around the property or swimming pool, which may cause
damage or offence to the neighbours. The hirer shall also ensure that all
rubbish is cleared away from the property and placed in the communal dustbins.
We rely upon the goodwill of our guests whose co-operation we greatly
appreciate. Should the property be left in a poor condition, requiring more
intensive cleaning, then this will be charged at £15 per hour and deducted from
the security deposit.
13. Damage to the property and
its contents
Except in the case of normal wear and tear the hirer will be responsible for
making good any damage to the property or its contents, which has occurred due
to negligence, wilful damage or irresponsible behaviour on the part of those
occupying the property and their guests. The hirer will pay for the cost of
replacement or rectifying damage.
14. Rights of access
The owners, our representatives, or subcontractors have the right to access the
property at any time with due regard to the convenience of the hirer for the
purpose of linen change, pool cleaning, gardening, and to carry out essential,
or routine repair or maintenance work.
15. Responsibilities
Neither the owners nor any of our representatives can be held responsible for
any circumstances beyond our control including, but not limited to, mechanical
breakdown, illness, swimming pool maintenance and failure of any public supply.
Water may be restricted or even cut off by the local supplier.
16. Noise levels
In the event of building work taking place by local authority, developers or
neighbours, it is important to note that the owners are not responsible for such
work, and are unable to stop such work taking place, or control the levels of
noise. This is also the same if neighbours own dogs - we cannot be
responsible for their barking.
17. Force Majeur
The owners regret that they cannot accept liability or pay any compensation
where the performance or prompt performance of their contractual obligations is
prevented or affected by ‘force majeur’. In these terms and conditions of hire,
‘force majeur’ means any event which the owners or the suppliers of the
service(s) in question could not, even with due care, foresee or avoid. Such
events may include, but are not limited to, war, threat of war, civil commotion
or strife, hostilities, strikes or other industrial disputes, natural disasters,
fire, acts of God, terrorist activities, quarantine, epidemics, weather
conditions, government action or other events outside our control.
18. Insurance
The property hire does not include insurance for the hirer and their party. It
is a condition of booking that insurance is taken out against cancellation,
personal accident and medical and to cover your personal belongings whilst
staying at the property. We will not be liable for any act, neglect or default
on the part of any person nor any accident, damage, loss, injury, expense or
inconvenience whether to person or property which the hirer or any other person
may suffer or incur arising out of or in any way connected with the letting or
resulting from any other cause whatsoever.
19. Conditions
abroad
European customs, habits and lifestyles may be different. Insects, including stinging/biting insects,
ants, spiders and rodents do find their way into
properties. Spiders can produce webs within 12 hours, and this does not indicate
poor cleanliness. These are local prevailing conditions totally outside our
control for which we cannot accept any liability. Cuts in water and electricity
supplies may occur at any time without warning. Electricity supplies cannot
always support several appliances being used simultaneously, and may fail if
overloaded. We cannot be held responsible for technical problems with the
property/facilities or technical/chemical problems with pools, or any problems
with any electrical appliance as a result of interruption to the electricity
supply. Also, remember, properties in Cyprus are built to Cyprus building
specifications, not UK.
20. No smoking
policy
The hirer agrees not to
smoke, nor to allow smoking, inside the property at any time. If this is not
strictly adhered to it will lead to a deduction from the deposit.
